General Terms of Sale

1. Purpose

These General Terms and Conditions govern the reservation and purchase of vehicles offered by the Dealership through the website.

2. Order Placement

Placing an order does not imply final acceptance of the transaction by the Dealership. The purchase will be finalized once express order confirmation has been issued and the established identification and payment requirements have been met.

3. Price

The prices shown include legally applicable taxes unless expressly stated otherwise.

Prices may vary until final order confirmation due to tax, regulatory, or manufacturer changes.

4. Availability

All vehicles are subject to stock and production availability.

In the event of unavailability, the Dealership will inform the Customer as soon as possible and offer equivalent alternatives or a refund of the amounts paid.

5. Reservation

Reserving a vehicle may require a deposit.

The reservation will remain valid for the period indicated during the purchase process.

6. Delivery

The delivery date provided is an estimate.

Delays due to causes beyond the Dealer’s control, including logistical, production, or administrative issues, will not automatically entitle the customer to compensation.

7. Payment

The Customer may make payment using the methods available on the platform.

Vehicle delivery is contingent upon full payment of the price or approval of the corresponding financing.

8. Financing

When the purchase is linked to financing, the transaction will be subject to approval by the collaborating financial institution.

Denial of financing may result in order cancellation.

9. Cancellations

The Customer may request order cancellation before the final purchase agreement is completed.

The conditions for refunding amounts paid will depend on the order processing status and the costs already incurred by the Dealership.

10. Legal Warranty

New vehicles sold by ABADAL AUTOMOVILES, S.A. to consumers carry a statutory warranty of two (2) years from the date of delivery, in accordance with Royal Legislative Decree 7/2021 of 27 April transposing Directive (EU) 2019/771 on contracts for the sale of goods.

In the event of a lack of conformity, the consumer is entitled to demand, at their choice:

Repair and replacement shall be free of charge to the consumer and shall cover all necessary costs incurred. The consumer shall not be entitled to terminate the contract where the lack of conformity is minor.

For used vehicles, the parties may agree a reduced warranty period, which may not be less than one (1) year from the date of delivery.

Any additional commercial warranties offered by the manufacturer or by ABADAL AUTOMOVILES, S.A. are supplementary to, and do not replace, the statutory warranty.

11. Right of Withdrawal

If the Customer is acting as a consumer and the purchase was made through a distance or off-premises contract, they have the right to withdraw from the contract without giving any reason within 14 calendar days from the day of delivery of the goods.

To exercise the right of withdrawal, the Customer must notify ABADAL AUTOMOVILES, S.A. by means of an unequivocal statement through one of the following channels:

The Customer may use the model withdrawal form available at Right of Withdrawal, although its use is not mandatory.

Upon withdrawal, ABADAL AUTOMOVILES, S.A. will refund all payments received, including delivery costs if applicable, within 14 calendar days of being informed of the decision to withdraw, using the same payment method as the original transaction.

The right of withdrawal does not apply in cases excluded by applicable regulations (e.g. goods made to the consumer’s specifications).

12. Data Protection

The personal data provided will be processed for the purpose of managing the contractual relationship, responding to inquiries, and complying with legal obligations.

13. Customer Service

Inquiries and complaints may be directed to customer service through the channels indicated on the platform.

14. Applicable Law

These terms and conditions shall be governed by Spanish law.

Any dispute will be submitted to the competent courts and tribunals in accordance with consumer and user protection regulations.
